Essential Components of Affirmative Action Programs

Well-prepared Affirmative Action Programs are essential to comply with OFCCP regulations and maintain both federal contractor status and harmonious relations with the OFCCP. Whether new to OFCCP compliance, returning to OFCCP compliance work after a sabbatical or looking for a refresher to make sure you did not miss something in the welter of change in this currently volatile OFCCP, attendees of this interactive and fast-paced session will have the opportunity to hear from DirectEmployers compliance team about practical ways to accomplish the major compliance obligations of Executive Order 11246, 38 USC 4212 and Section 503 of the Rehabilitation Act. The presenters will also discuss the largest OFCCP "money issue" and how to properly undertake statistical Disparity Analyses for hires, promotions and involuntary terminations.

Creating Your First Section 503 Utilization Analysis and First-Ever Sections 503/4212 "Effectiveness Reviews": How Not To Flunk Yourself

As the OFCCP continues to roll out additional regulatory changes, this session will educate federal contractors on two very important topics: Section 503 Utilization Analyses and Section 503 and Section 4212 outreach effectiveness reviews. During the Section 503 Utilization Analyses portion, employment Law expert John C. Fox will discuss the OFCCP's new requirement under Section 503 that contractors use the "any difference" rule to measure achievement with OFCCP's Utilization Goal in each of the contractor's Job Groups (not 80%; not 2 Standard Deviations; not Fischer's Exact, etc). He will also demonstrate that an organization will simply undertake more outreach efforts and not be judged by "good faith efforts" (GFEs are now unique to only EO 11246) if an organization has set a utilization goal for one or more job groups. This session will also include:

  • Recounting the outreach efforts OFCCP's Section 503 regulations impose for each Job Group in which a company employs fewer than 7% disabled employees
  • Discussing practical and effective outreach and recruitment efforts
  • Showcasing how DirectEmployers PRM tool will assist contractors to document/catalog their outreach efforts

With regard to Section 503 and Section 4212 Outreach Effectiveness Reviews, Candee Chambers will discuss the annual newly required "Effectiveness Reviews" all contractors must now undertake. These Reviews cause an organization to first catalogue each individual outreach effort and to then determine whether each effort was "effective" or not. Candee will also discuss how one knows if a company's outreach efforts have been "effective," as well as the 5-part "Data Metrics Reports" contractors must now compile pursuant to both Sections 503 and 4212 in support of the annual "Effectiveness Reviews."

Attendees will leave this session with sample Utilization Analyses and Data Metric Reports and Effectiveness Reviews of our own design, both of which will meet the OFCCP's new Section 503 and Section 4212 rules.

The Proper Way for Contractors to Prepare Disparity Analysis in Affirmative Action Plans

One of the most interesting facts often unknown by federal contractors is that they are not actually required to perform adverse impact analyses as part of their affirmative action plans (AAP). Instead federal contractors are required to perform a disparity analysis to show that their selection process is legitimate and non-discriminatory. Put in terms of required and non-required this makes sense, but what is a disparity analysis and how is it conducted? Join this session to understand how to properly conduct a disparity analysis so you can stay one step ahead of the OFCCP regulatory obligations.
